TERMS AND CONDITIONS FOR SERVICES PROVIDED BY THE ONLINE STORE AJ Kwiatkowscy and zamglawiacze.pl

I. General Provisions

The owner of the online store at www.ajkwiatkowscy.pl is the company Andrzej i Józef Kwiatkowscy s.c., registered in the Central Register and Information on Economic Activity (CEiDG), with its address at ul. Przyjaźni 4/29, 20-314 Lublin, NIP (Tax ID): 9462445132, REGON (National Business Register ID): 060003606, email: sklep@ajkwiatkowscy.pl, tel. 697026236, hereinafter referred to as the Seller. These terms and conditions define the scope and conditions for the provision of services by the online store operated by the Seller.

The party making purchases, hereinafter referred to as the Customer, must be an entrepreneur. An entrepreneur is a natural person, a legal person, or an organizational unit without legal personality, conducting business or professional activity on its own behalf.

II. Orders

1. Methods of placing orders:

  • Online store: Click the basket icon ("Add to Cart") next to the product. After adding all products to the cart, select the delivery and payment method, and complete the billing details. Then, confirm the order.

2. Placing an order through the online store and receiving an email confirming the order is not equivalent to signing a civil law contract within the meaning of the Civil Code.

3. After placing an order through the online store, the Customer receives the following emails:

  • Confirmation of order placement, which does not yet mean acceptance of the order for processing.

  • Confirmation of order acceptance for processing. For orders paid by bank transfer, the message includes payment details.

4. Orders can be placed 24 hours a day, throughout the year. Orders placed on weekdays after 12:00 PM will be processed on the next business day. Orders placed on Saturdays, Sundays, and holidays will be processed on the next business day. In special cases, orders are processed immediately.

5. A prerequisite for order fulfillment is the correct completion of the data form.

6. The prices of goods in the store are given in Polish Złoty (PLN). Product prices include VAT (gross). The Seller reserves the right to change prices on the website without prior notice and without stating a reason.

7. The Seller begins order fulfillment immediately after confirmation and receipt of payment to the account.

8. In case of an item being out of stock, the Customer will be informed about this fact, as well as about the extended order fulfillment time. If the Seller does not receive a response to their contact attempt for more than 7 days, the order will be canceled.

9. Each shipment includes a VAT invoice and other documents, such as safety data sheets, certificates, permits for chemical preparations, warranty cards for devices, manuals, etc.

10. Confirmation of order acceptance by the Seller constitutes acceptance of the offer for fulfillment.

11. The Seller reserves the right to refuse order fulfillment in special cases:

  • Doubtful customer data,

  • System errors or store operation errors,

  • Quantitatively limited goods, items subject to promotion or clearance sales.

III. Payment Methods

12. Payment for goods can be made by:

  • Bank transfer: The order will be fulfilled when funds are credited to the Seller's bank account. Goods are shipped immediately after payment is posted and the order is completed.

  • Cash on Delivery (COD): The amount due is collected by the courier or Polish Post employee delivering the goods to the Customer.

  • Deferred payment (payment on terms): Only after individual arrangement, an option for regular customers.

13. Payment for an online order should be made by bank transfer to the Seller's company account, Credit Agricole bank account number: 97 1940 1076 3157 4561 0000 0000.

14. Always include the order number in the bank transfer instruction or postal money order form.

15. The Seller reserves the right to change payment methods. The Customer will be immediately informed of such a situation by phone or email.

IV. Product Shipping

16. Shipments are delivered using courier companies and a network of regional representatives. The costs of shipment delivered by a courier company depend on the weight of the ordered goods. Different pricing applies to oversized shipments and high-value shipments.

17. Order fulfillment time is from 1 to 14 business days. The order fulfillment time includes preparing the shipment for delivery and the time for delivery to the specified address.

18. In special cases, order fulfillment time may be extended, and promotional offers may be time- and quantity-limited.

20. Goods are shipped within Poland and across the European Union. Should you require shipping outside of Poland, the cost will be calculated individually.

V. Withdrawal from the Contract

A Buyer with Consumer status may withdraw from a sales contract for Goods purchased from the Seller without stating a reason, by submitting a written statement within fourteen days, counting from the day of delivery of the Goods (i.e., from the day the Consumer received the Goods). To meet this deadline, it is sufficient to send the statement before its expiry. It is recommended to send the aforementioned statement of withdrawal to the correspondence address.

The right to withdraw from the contract does not apply to the Consumer in cases of:

  • Services with properties specified by the consumer in the order placed by them or strictly related to their person.

  • Services which, due to their nature, cannot be returned or whose subject deteriorates quickly.

  • The provision of services commenced, with the consumer's consent, before the expiry of the period referred to in Article 7(1) of the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by a dangerous product.

In the event of withdrawal, the Consumer is obliged to return the Goods in an unchanged state, unless the change was necessary within the limits of ordinary management. The Consumer is obliged to return the Goods immediately, no later than 14 days from the date of withdrawal from the contract. The cost of the Goods, together with shipping costs incurred by the Consumer during the purchase of the Goods, will be refunded by the Seller within 14 days from the date of withdrawal from the contract. A Buyer not having Consumer status is not entitled to withdraw from the contract within ten days. For such Buyers, the rules and terms of withdrawal from the contract are regulated by the provisions of the Civil Code. A Consumer who has withdrawn from the contract sends the Goods to the Seller at their own expense; this cost is not refundable.

VI. Warranty and Service

21. The Customer has the right to return purchased goods without giving a reason within 14 days, counted from the date of delivery of the goods by the courier. Return is possible if: the goods show no signs of use, have complete, undamaged packaging, security seals, and attached documentation. The Customer is obliged to send the goods back at their own expense to the Seller's warehouse address. Each return must be agreed upon by phone with the store. Unarranged shipments will not be accepted. The amount due for the returned goods will be transferred to the account within 7 days from the date of return approval.

22. During the warranty period, technical problems are handled by authorized service centers nationwide. The addresses of individual service points can be found in the warranty card.

23. Upon delivery of the goods, the Customer is obliged to check whether the shipment has any damage incurred during transport, and whether it complies with the order. Stating damaged, incomplete, or non-compliant shipment to the courier and preparing a claim protocol is the only basis for considering a potential complaint. In such a situation, the Seller will replace the product with a fully functional one. If this is not possible, e.g., due to stock depletion, the Seller will offer other products to choose from or refund the amount paid.

24. The Seller will not accept any shipments sent back "cash on delivery" without prior telephone arrangement.

25. The Seller will not accept shipments whose content has not been previously agreed upon.

26. Liability under warranty for physical defects of the goods is excluded, in accordance with Art. 558 § 1 of the Civil Code.

VII. Final Provisions

27. The offer is valid only within Poland.

28. All personal data obtained during the store's operation are confidential and will under no circumstances be disclosed to third parties or other entities, in accordance with the Act of August 29, 1997, "On the Protection of Personal Data". In accordance with this Act, the customer has the right to access their data, correct them, and request to cease their use. 29. Information contained on the website constitutes only an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.

30. By placing an order, the Customer accepts the above regulations.

31. The store is not responsible for the content of technical data of equipment or for photos included in the manual.

Personal data provided by our Customers in parts of the store that allow user interaction (e.g., product reviews) are publicly visible to all readers of these store pages. We have no way of filtering or securing them against unauthorized use by third parties.

Andrzej i Józef Kwiatkowscy s.c. collects only data that is necessary for concluding a contract and providing sales services, handling returns and complaints, contacting the customer to inform them about any changes related to the purchase process, answering customer questions, and marketing other events available in the offer of ajkwiatkowscy.pl or zamglawiacz.pl.

The data required to provide sales services, which include telephone sales support when payment has not been made, handling returns, complaints, and informing about any changes regarding the event, include:

PERSONAL DATA AND PRIVACY POLICY OF AJKWIATKOWSCY.PL AND ZAMGLAWIACZE.PL

This document constitutes an integral part of the regulations and the agreement that the User enters into with the Administrator through registration using the form.

The Administrator of the data is Andrzej i Józef Kwiatkowscy s.c., which operates in accordance with the provisions of the Act of August 29, 1997, on the Protection of Personal Data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended) and the Act of July 18, 2002, on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended). The Administrator is authorized to disclose personal data only to entities authorized under applicable law, in accordance with the principles of the Privacy Protection Policy, the provisions of the Regulations, and applicable law. The website owner undertakes to securely store data and not to transfer it to third parties. By registering on ajkwiatkowscy.pl or zamglawiacze.pl, the User agrees to the processing of data for the proper performance of the contract between them and Andrzej i Józef Kwiatkowscy s.c. Personal data and information contained in the registration form will be used by the Administrator for the conclusion, amendment, termination of the contract with the User, and for ensuring the highest quality of services provided. The User provides their personal data necessary for registration voluntarily. The User has the right to access their data. The User has the right to request the deletion or correction of data in ajkwiatkowscy.pl or zamglawiacze.pl originating from the registration form, by sending an email to the administrator, Andrzej i Józef Kwiatkowscy s.c. In the event of a request for deletion of data necessary for the proper performance of the contract, the User's Account will be deleted. The Administrator sends information to the email address provided by the User. In the event that the Administrator has doubts about the truthfulness or timeliness of the registration data provided by the User, the Administrator is authorized to take the following actions:

  • call on the User to immediately delete incorrect data or update the data,

  • immediately block the performance of the service until the matter is clarified. The website administrator undertakes to apply technical and organizational measures ensuring data protection, in particular by securing data against unauthorized access by unauthorized persons. It is forbidden for the User to publish or use for marketing purposes personal data, including photos of third parties, without their consent. The Administrator is not responsible for the User's illegal actions if they were not informed of the infringement. Upon receiving information about a legal infringement, the Administrator is obliged to take immediate action to eliminate the consequences caused by the violation of law. The content and opinions expressed in the store by its visitors remain their property. We do not take any responsibility for them, nor do we identify with them. They do not always align with our views and opinions.
